Independent Legal Advice
Independent Legal Advice (ILA) refers to legal guidance provided by a lawyer who is fully separate from and uninfluenced by any other party involved in a transaction or agreement.
Its purpose is to ensure that an individual clearly understands the nature, consequences, and potential risks of the document they are signing, and that their decision is made voluntarily and without pressure or coercion.
ILA is commonly required in situations such as separation agreements, or prenuptial agreements etc.
During an ILA consultation, the lawyer will review the document, explain the legal implications in plain terms, assess the client’s capacity and willingness to proceed, and confirm that their consent is informed.
